Terms and Conditions of the Kingway Online Store

Defining, among others, the rules for concluding sales contracts via the store, containing the most important information about the Seller, the Store, and the rights of the Consumer.

Provisions concerning the privileged Entrepreneur apply to contracts concluded from January 1, 2021.

§ 1 Definitions

• Business Days – days from Monday to Friday, excluding public holidays.
• Consumer – a consumer as defined by the Civil Code regulations.
• Buyer – any entity making purchases in the Store.
• Privileged Buyer – a Consumer or a Privileged Entrepreneur.
• Privileged Entrepreneur – a natural person entering into a contract with the Seller related to their business activity, but not of a professional nature (applies from January 1, 2021).
• Terms and Conditions – these terms and conditions.
• Store – the KINGWAY online store operating at kingwayshop.com.
• Seller – EKO DOC, USt-ID: 8982307737, UL. KSIECIA WITOLDA 49 / 15, 50-202 BRESLAU.

§ 2 Contact with the Seller

§ 3 Technical Requirements

To use the Store properly, the following are necessary:

• A device with Internet access.
• A web browser supporting JavaScript and cookies.
• An active email account (for placing orders).

§ 4 Shopping in the Store

• Prices of products visible in the Store are total prices (including VAT).
• The total order price includes the product price and potential delivery costs.
• Selected products should be added to the cart, and then the delivery method, payment method, and order details should be provided.
• An order is placed after the Buyer accepts the Terms and Conditions, which constitutes the conclusion of the sales contract.
• Buyers can make purchases without registering an account in the Store.

§ 5 Payments

The Buyer may choose one of the available payment methods:

• Electronic payment,
• Payment on delivery (via bank transfer or cash).

For upfront payments, the payment must be made within 7 business days of placing the order.

§ 6 Order Fulfillment

• The Seller undertakes to deliver goods free of defects.
• The order fulfillment period is up to 4 business days unless the Buyer has specified a deferred delivery date.
• The order process begins after payment, if the Buyer chooses an upfront payment method.
• Deliveries are made within Europe.

§ 7 Right to Withdraw from the Contract

Privileged Buyers have the right to withdraw from the contract within 14 days without providing a reason. Details about the right of withdrawal, returns, and its consequences can be found in the full Terms and Conditions.

§ 8 Exceptions to the Right of Withdrawal

The right to withdraw from a distance contract does not apply to:

• Products made to the Buyer’s special order,
• Perishable goods,
• Goods in sealed packaging if the packaging has been opened after delivery.

§ 9 Complaints

• In the event of defects, the Consumer can file a complaint based on warranty or, if granted, a guarantee.
• Complaints should be sent to the postal or email address provided in § 2 of the Terms and Conditions.
• Complaints regarding the Store's functionality should also be directed to the Seller's email address.

§ 10 Personal Data

The administrator of the Buyer’s personal data is the Seller. Data is processed for the purpose of order fulfillment and user account management in accordance with the privacy policy available on the Store’s website.

§ 11 Reservations

• Buyers are prohibited from providing unlawful content.
• Each order placed in the Store constitutes a separate sales contract.
• Contracts are concluded in English.
• In case of disputes with non-privileged Buyers, the competent court is the court at the Seller’s registered office.
